Although a federal judge has denied nationwide class to plaintiffs alleging CoreLogic National Background Data harmed plaintiffs by providing criminal and sex offender registry data on their background checks that belonged to someone else, the plaintiffs may still pursue subclasses. While CoreLogic NBD contends it is not a consumer reporting agency as defined by the FCRA, as access to its database is not provided to employers but PreEmployment screening companies the Virginia Federal Judge states the law is not limited to background check providers that provide information to end users.
